29 CFR 1926.651(b)(2):Utility companies or owners shall be contacted within established or customary local response times, advised of the proposed work, and asked to establish the location of the utility underground installations prior to the start of actual excavation. When utility companies or owners cannot respond to a request to locate underground utility installations within 24 hours (unless a longer period is required by state or local law), or cannot establish the exact location of these installations, the employer may proceed, provided the employer does so with caution, and provided detection equipment or other acceptable means to locate utility installations are used. On or about June 27th, 2025, employees engaged in trenching operations located at 2525 North 117th Ave, Omaha, Nebraska 68117 were exposed to electrical shock in that a mismarked energized electrical underground utility line was struck when digging a trench to repair a water main leak. The employer utilized a 3rd party locating service to locate the utilities underground; however, the employer failed to provide additional equipment or other acceptable means to ensure the utility was properly located before digging. As a result, an employee struck an underground line and was hospitalized and treated for electrical shock.

29 CFR 1926.651(d):Employees exposed to public vehicular traffic were not provided with a warning vest or other suitable garments marked with or made of reflectorized or high-visibility material: On or about June 27th, 2025, employees engaged in trenching operations located at 2525 North 117th Ave, Omaha, Nebraska 68117 were exposed to struck-by hazards in that employees were working on the side of a road in between multiple intersections at night, and they were not wearing suitable garments marked or made of reflective or high visibility material.
