OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to struck-by and crushing hazards from collapsing storage racks due to missing bolts to secure the racks:  (a) Establishment, Warehouse area - On or about July 1, 2025, employees were exposed to struck-by and crush-by hazards while performing work activities such as, but not limited to operating powered industrial trucks (PIT) to move pallets of materials,  such as doors and windows, on and off of Ridg-U-Rak steel storage rack systems.  The employer did not ensure that all of the base plates of the rack columns (posts) were anchored to the warehouse floor with anchor bolts to prevent the racks from collapsing from PIT impacts or loading/unloading forces.

29 CFR  1910.30(a)(3)(iii): The employer did not train each employee in the correct procedures for installing, inspecting, operating, maintaining, and disassembling the personal fall protection systems that the employee uses:  a) Warehouse, Storage racks- On or about July 1, 2025, an employee was required to operate a Crown Order Picker, serial number 1A195351, to retrieve products. The employee had to retrieve orders approximately 20 feet above the ground without fall protection. The employee was not provided with fall protection training.
