In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a) On or about July 2, 2025, on the 8/12 pitch roof of Lot #64; employee(s) operated pneumatic nail guns without utilizing eye or face protection while performing shingle installation activities on the exterior of the new residential construction.  Alejandro Rivera was previously cited for a serious violation of this Occupational Safety and Health Standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1531626, citation number 1, item number 1, and was affirmed as a final order on July 27, 2021 with respect to a workplace located at 1151 Mountain Laurel Circle, Lot #13, Moody, AL 35004.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
