29 CFR  1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, was not protected by protective helmets.  a) On July 2, 2025, at or near the corner of 24th Street NW and 8th Ave NW, Mandan, ND, an employee was exposed to a struck by hazard when he was not wearing head protection while there was overhead hazards while working inside a trench.

29 CFR  1926.651(j)(2):Employees were not protected from excavated or other materials or equipment that posed a hazard by falling or rolling into excavations and protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  a) On July 2, 2025, at or near the corner of 24th Street NW and 8th Ave NW, Mandan, ND,  employees were exposed to cave in hazards when working in a trench installing a gas line where the spoil pile was not set back two feet.

29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  a) On July 2, 2025, at or near the corner of 24th Street NW and 8th Ave NW, Mandan, ND,  employees were exposed to cave in hazards when working in a trench installing a gas line where employees were working outside of the sloped area of the trench without additional protective systems in place.
