29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) Ricardo's Construction failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected.  Citation 1, Item 3 a serious violation of 29 CFR 1926.503(a)(1) with an abatement date of August 14, 2025.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  (a) On or about July 2, 2025, at 1742 Hammock Lane, Oconomowoc, WI 53066, the employer did not ensure employees conducting framing operations, using hand tools and nail guns were wearing eye protection. This exposed the employees to struck by hazards and eye injuries.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about July 2, 2025, at 1742 Hammock Lane, Oconomowoc, WI 53066, employees framing a new residential home were not using fall protection. This exposed the employee to a fall hazard of approximately 11 feet 7 inches from the roof eve to the ground below on the back side of the home.
