29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  At the workplace located at 206 Southeast Airport West Drive Topeka, Kansas, employees were exposed to respiratory hazards. Employees in the stone cutting and polishing work areas were required to wear tight fitting HDX N95 particulate respirators. The employer did not provide a medical evaluation to determine the employees ability to safely use a respirator.

At the workplace located at 206 Southeast Airport West Drive Topeka, Kansas, employees were exposed to respiratory hazards. The employer did not ensure that respirators used by employees were stored properly to protect from silica dust contamination. Respirators were observed sitting on a work bench exposed to workplace contaminants.
