29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition. a. On or about June 30, 2025, in the freezer area, a buildup of ice on the floor created hazardous, slippery walking-working surfaces, when an operator lost control of the powered industrial vehicle (PIV), due to the icy conditions and sustained a serious injury to their left foot that was crushed between the PIV and a fixed post. b. On or about July 7, 2025, there was a build-up of ice on the freezer floor creating a potential slip hazard for powered industrial trucks and personnel.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. a. On or about June 30, 2025, the employer failed to ensure that employee(s) who operate powered industrial trucks, including Crown, Model Number RD5725-32, Serial Number 1A539293, were properly trained, evaluated and certified to perform the tasks in a safe manner, thereby exposing employees to struck-by hazards.
