29 CFR 1910.1053(d)(1): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section: a) On August 15, 2025, Kitchen Transformations, Inc. dba Granite Selection did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section. One employee was exposed to respirable crystalline silica at 18.6 ?g/m3 while performing finishing of engineered stone countertops. No abatement certification or documentation is required for this item.

29 CFR 1910.1053(j)(3)(i): Employee information and training. (i) The employer shall ensure that each employee covered by this section can demonstrate knowledge and understanding of at least the following: (A): The health hazards associated with exposure to respirable crystalline silica. (B): Specific tasks in the workplace that could result in exposure to respirable crystalline silica. (C): Specific measures the employer has implemented to protect employees from exposure to respirable crystalline silica, including engineering controls, work practices, and respirators to be used; (D): The contents of this section. (E): The purpose and a description of the medical surveillance program required by paragraph (i) of this section. a) On or about August 15, 2025, the employer did not ensure that all employees exposed to respirable crystalline silica in the finishing area could demonstrate knowledge of the contents of this standard and the purpose and description of the medical surveillance program required by the standard. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
