29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: At the workplace located at 19745 West 159th St. Olathe, Kansas, employees engaged in automotive maintenance activities throughout the facility were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the facility. Employees were handling Mobil 1 and Mobil Super synthetic engine oils, Chemisphere brake and parts cleaner, Crystal Clean Light Duty Global antifreeze/coolant, Safety-Kleen premium solvent, and other cleaning chemicals. The chemical hazards associated with these chemicals include: skin and eye irritation/burns, drowsiness and/or dizziness, nausea and/or vomiting, respiratory tract irritation, gastrointestinal damage/irritation, may cause cancer and may be fatal if swallowed and enters airways. Additionally, Chemisphere brake and parts cleaner and Safety-Kleen premium solvent, can both act as a fueling agents due to their flammability as a liquid and/or vapor.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical: At the workplace located at 19745 West 159th St. Olathe, Kansas, employees engaged in automotive maintenance activities throughout the facility were exposed to chemical hazards when using unlabeled chemical containers. Unlabeled secondary pressurized cylinder containers filled with Chemisphere brake and parts cleaner were found on several toolboxes throughout the shop of the facility. Exposure to this chemical could result in: skin and eye irritation, drowsiness and/or dizziness, may cause genetic defects and may cause cancer. Additionally, Chemisphere brake and parts cleaner can act as a fueling agent due to its flammability as a liquid and/or vapor.
