OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed-by and caught in-between hazards: Location: 80 West St. Spring Valley, NY 10977 On or about: July 7, 2025, and times prior thereto: a) Employees were exposed to crushed-by and caught in-between hazards while riding a PFlow Industries hydraulic vertical reciprocating conveyor (VRC) designed to move material or freight in multi-story buildings but not people. The VRC was used as a passenger elevator by employees and supervisors to travel between the basement and first floor multiple times daily, and this activity was witnessed by management. An employee transporting food and products suffered a fatal injury while riding the lift from the basement to the first floor. Employees were not protected from moving parts and were exposed to being crushed-by and caught-in while VRC was in motion. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN ADDITIONAL PENALTY OF $1000.00 AS PER CFR 1903.19.
