29 CFR  1910.1200(g)(8): The employer shall maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s). (Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.)  a.  On or about July 02, 2025 and times prior, located at 6675 Cincinnati Zanesville Road, Lancaster, Ohio 43130, the employer did not ensure that the required and up-to-date Safety Data Sheet (SDS) for CrackMaster P.L., Product Code M1070, was readily accessible to employees during the performance of asphalt sealing tasks.  Failing to maintain the up-to-date SDS exposed employees to burn hazards as a result.

29 CFR  1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used:    a.  On or about July 02, 2025 and times prior, located at 6675 Cincinnati Zanesville Road, Lancaster, Ohio 43130, the employer did not ensure that employees were trained to protect themselves from burn hazards when they performed work with the CrackMaster P.L., Product Code M107.  Employees performed their work task without receiving proper training on the correct use and wear of personal protective equipment, such as but not limited to faceshield and protective clothing for exposed skin.  Failing to ensure that employees were trained exposed them to injurious hazards as a result.

Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.  a.  On or about July 02, 2025 and times prior, located at 6675 Cincinnati Zanesville Road, Lancaster, Ohio 43130, the employer did not ensure that each affected employee used the appropriate protective clothing for exposed skin on their extremities, when they performed their asphalt sealing tasks with the hot hazardous material such as, but not limited to the CrackMaster P.L., Product Code M1070.  This condition exposed employees to injurious burn hazards as a result.

This condition exposed employees to injurious burn hazards as a result.
