OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause serious physical harm to employees in that employees were exposed to slip, amputation, and struck-by hazards associated while operating lawn mower equipment on a slope. On or about July 1, 2025, at an establishment located at 209 East Blossom Street in Ripon, Wisconsin; an employee operating a Ryobi 20-inch 40V walk-behind lawn mower was exposed slip, amputation, and struck-by hazards while mowing grass at a decline of approximately 29 degrees.

General-duty citation text
29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: (i) Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment; (ii) Communicate selection decisions to each affected employee; and, (iii) Select PPE that properly fits each affected employee. On or about July 1, 2025, at an establishment located at 209 East Blossom Street in Ripon, Wisconsin; the employer did not assess the workplace to determine if hazards were present, or likely to be present, which necessitated the use of provide personal protective equipment (PPE) while employees were operating lawn mowers while cutting grass. Such PPE includes, but is not limited to, eye and foot protection and non-slip footwear when employees are exposed to flying particles, contact with rotating blades, and slippery walking surfaces.
