29 CFR  1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D).  Cornerstone Crushing, LLC at the worksite located near Indian Bridge Ln., Defiance, Ohio: On or about July 2, 2025, the employer did not ensure that energy control procedures identified specific steps to follow to control hazardous energy of the Lippman 4248LP.  Procedures did not provide specific procedural steps to shut down the equipment, specific procedural steps for blocking and/or placement of lockout devices, and lacked specific steps to verify absence of energy.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR  1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6).  Cornerstone Crushing, LLC at the worksite located near Indian Bridge Ln, Defiance, Ohio: On or about July 2, 2025, employees who adjusted the apron of the Lippman 4248LP Crushing Plant (no. 20220112) were exposed to pinch point hazards created by the apron's adjustment jam nut in that the equipment was not locked out prior to adjusting the apron.  The employer did not ensure that energy control applications steps were implemented to control the equipment's electrical energy source prior to the servicing tasks - the employer did not: - Ensure that equipment was turned off or shut down. - Physically operate energy isolating devices to control energy sources and affix lockout device(s). - Ensure that all potentially hazardous stored or residual energy was relieved, disconnected, and rendered safe. - Verify that isolation and de-energization of the machine or equipment had been accomplished.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR  1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  Cornerstone Crushing, LLC at the worksite located near Indian Bridge Ln., Defiance, Ohio: On or about July 8, 2025, the employer failed to report an amputation injury to an employee.  On July 2, 2025, an employee sustained a partial finger amputation injury; the employer did not report the amputation within twenty-four hours.
