29 CFR 1926.652(c)(2)(i): Design of support systems, shield systems, or other protective systems that are drawn from manufacturer's tabulated data were not in accordance with all specifications, recommendations, and limitations issued or made by the manufacturer:  a) On July 10, 2025, at the above addressed jobsite, employees in excavations were not provided with adequate cave-in protection as the protective system that was being utilized was not installed in accordance with all specifications.  The Speed Shore Hydraulic Shoring was not pressurized to the correct pounds per square inch, the finn board and shore was not positioned to put pressure on the walls of the excavation, a single vertical shore was used where a minimum of two were needed in an excavation that was approximately six feet nine inches in depth, and the hose from the hydraulic pump can had not been disconnected after pressurization of the shore had been applied.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) On July 10, 2025, at the above addressed jobsite, the portable Werner Straight Ladder used by employees to access and egress the trench, measuring approximately six feet nine inches in depth, did not extend at least three (3) feet above the upper landing surface.    Millennium Contracting Co. was previously cited for a violation of this occupational safety and health standard 29CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1518669, citation number 1, item number 1b and was affirmed as a final order on September 20, 2021, with respect to a workplace located at 7435 N Overhill Avenue in Chicago, Illinois.  No abatement certification or documentation is required for this item.
