OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees using portable gasoline powered cut-off saws were exposed to struck by and/or laceration hazards from saw kick-backs while cutting unsupported concrete pipes with bell ends. On or about July 7, 2025, the employer did not ensure that concrete pipes with bell ends were adequately supported to prevent saw kickbacks during cutting activities. On July 7, 2025 an employee was injured from a kickback while using a Husqvarna K97011 gasoline powered saw to cut a concrete pipe for the installation of a new sewer.

29 CFR 1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about July 7, 2025, employees cutting concrete pipes with a gas-powered, hand held saw were exposed to injuries associated with kick backs and the employer did not provide training to the employees in the processes or steps necessary to eliminate or minimize the hazards.

On or about July 7, 2025 an employee suffered a work-related injury that resulted in hospitalization and the employer did not report the hospitalization within 24 hours of learning of the hospitalization. The employer reported the hospitalization of the employee to OSHA on July 9, 2025.
