29 CFR  1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  (a)Orth Custom Homes, LLC at 11276 Roundup Court, Lead, SD 57754: On or about and at times prior to July 9, 2025, the employer did not ensure that employees were protected from falls while installing siding from the roof of a single-family residential home. This condition exposed the employee to fall hazards greater than six feet.

This condition exposed the employee to fall hazards greater than six feet.

29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a)Orth Custom Homes, LLC at 11276 Roundup Court, Lead, SD 57754: On or about and at times prior to July 9, 2025, the employer employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person.  Employees were exposed to various fall hazards from roofs, ladder fall hazards, and eye injuries due to lack of eye protection while conducting residential siding activities. This condition exposed employees to a variety of fall and eye hazards identified on site.

29 CFR  1926.102(a)(1): The employer did not ensure employees used eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:   (a)Orth Custom Homes, LLC at 11276 Roundup Court, Lead, SD 57754: On or about and at times prior to July 9, 2025, the employer did not ensure that all employees wore appropriate eye and face protection while operating pneumatic nail guns conducting residential siding operations.  This condition exposed employees to struck-by hazards associated flying debris.
