29 CFR 1910.178(n)(4): Powered industrial trucks. The driver shall be required to slow down and sound the horn at cross aisles and other locations where vision is obstructed. If the load being carried obstructs forward view, the driver shall be required to travel with the load trailing. a) On or about July 7, 2025, the employer failed to ensure that Powered Industrial Vehicle (PIV) operators slowed down and sounded the horn at locations where vision was obstructed. An employee operating a forklift down an aisle where another employee was positioned between high-stacked products inside the shelving system, obstructing visibility. As a result, an employee was struck when a forklift operator kept on driving in the fill-in aisle.

Training program content. workplace-related topics: Other unique or potentially hazardous environmental conditions in the workplace that could affect safe operation. a) On or about July 7, 2025, the employer failed to train employees on unique or potentially hazardous environmental conditions that could affect the safe operation of Powered Industrial Vehicles (PIVs). Specifically, employees were not trained on the hazard of obstructed visibility caused by high-stacked products within the shelving system, which concealed coworkers from view during order picking operations. As a result, employees were exposed to struck-by hazards.
