29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: (a) On or before July 15, 2025, the controlling employer, D&J Johnson Enterprises, Inc. dba Performance Construction, did not ensure that subcontracted employees were protected from fall hazards. The employees were conducting roofing operations on two-story residential building and were not utilizing a fall protection system. The employer, D&J Johnson Enterprises, Inc. dba Performance Construction, was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1714954, citation number 1, item number 1, and was affirmed as a final order on March 22, 2024, with respect to a workplace located at 17585 Celestine Ct, Parker CO, 80134.
