29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury.  (a)GMAC Construction LLC, 4405 Rt 1, Monmouth Junction, NJ: The employer did not instruct employees in the recognition and avoidance of unsafe practices nor prevent employees from being near the lull while in operation, as required by the operator's manual of the JLG Skytrak lull (pg. 24), which states "keep others away while operating." This failure exposed employees to struck-by hazards.  (b)GMAC Construction LLC, 4405 Rt 1, Monmouth Junction, NJ: The employer did not instruct employees in the recognition and avoidance of unsafe practices nor prevent a subcontractor employee, who was the lull operator, from using the tip of the forks to pry wooden forms loose, as prohibited by the operator's manual of the JLG Skytrak lull (pg. 121), which states "do not pick up a load or pry materials with tip of fork extensions." This failure exposed employees to struck-by hazards.   Condition occurred on or about 07/16/2025.

29 CFR  1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.    1910.178(l)(2)(ii) Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.    a.)GMAC Construction LLC, 4405 Rt 1, Monmouth Junction, NJ/ The employer did not complete the required onsite forklift evaluation for a subcontractor employee, who was operating the JLG Skytrak lull (serial #0160128201). This condition exposed employees to struck-by hazards.  Condition noted on or about 07/16/2025.
