29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces: a.) 425 South Salem Church Road, York, PA 17408 - Hexamine Handling and Mixer Area - On or about July 22, 2025, employees were performing maintenance activities inside of permit required confined spaces, including, but not limited to, the Eirich mixers, which require bodily entry. The employer did not inform employees of permit required confined space entry hazards via posted signage, or any other equally effective means. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.146(d)(9): Under the permit space program, the employer did not develop and implement procedures for summoning rescue and emergency services, for rescuing entrants from permit spaces, for providing necessary emergency services to rescued employees, and for preventing unauthorized personnel from attempting a rescue: a.) 425 South Salem Church Road, York, PA 17408 - Confined Space Program - On or about July 22, 2025, employees were performing maintenance activities inside of permit required confined spaces, including, but not limited to, the Eirich mixers, which require bodily entry. The employer did not develop and implement any rescue provisions including procedures for summoning rescue and emergency services, for rescuing the employee from the mixers (including provisions for non-entry rescue), for providing necessary emergency services to a rescued employee, and for preventing unauthorized personnel from attempting a rescue. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

The employer's entry permit did not identify the rescue and/or emergency services or the methods to contact those services. b.) 425 South Salem Church Road, York, PA 17408 - Hexamine Handling and Mixer Area - On or about July 22, 2025, employees were performing maintenance activities inside of permit required confined spaces, including, but not limited to, the Eirich mixers, which require bodily entry. The employer's entry permit did not identify equipment, such as personal protective equipment, testing equipment, communications equipment, alarm systems, and rescue equipment. f.) 425 South Salem Church Road, York, PA 17408 - Hexamine Handling and Mixer Area - On or about July 22, 2025, employees were performing maintenance activities inside of permit required confined spaces, including, but not limited to, the Eirich mixers, which require bodily entry. The employer's entry permit did not identify any additional permits that had been, or would have been needed to be issued to authorize work in the permit space.
