29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a) Merlin Industries Inc.- Raw material storage Area/production area: Employees were operating the Crown propane forklift Model #FC 4500 Series, S/N 9A224068, and the Toyota electric forklift truck Model 8FBE18U, S/N 25691 with forklift attachments to insert into the fabric roll's core. The attachments did not have any markings and were used without obtaining the forklift manufacturer's written approval for the attachment usage, occurred on or about 07/22/2025.

29 CFR 1910.219(d)(1): Pulley(s) with part(s) seven feet or less from the floor or work platform were not guarded in accordance with the requirements specified in 29 CFR 1910.219(m) and (o): a) Merlin Industries Inc. - Sewing area: The Consew Keystone Model #R733R, Serial #F14 sewing machine had unguarded pulleys located on the side of the machine and underneath the machine. The machine operator and the helper are exposed to crushing hazards while placing material/fabric next to an unguarded pulley exposing them to ingoing nip points. In addition, the operator runs the machine in a sitting position, and her legs are near the second in going nip point of that same pulley located underneath the machine. Observed on or about 07/22/2025.

The establishment employed 300 employees and was classified as NAICS 333994 during the calendar year 2024. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
