Violation occurred on or about June 27, 2025.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a) 543 13th Avenue, Newark, NJ  The employer did not ensure that the employee working on the Alum-A-Pole pump jack scaffolding, approximately 20 feet above the ground, was protected from fall hazards. The worker was installing siding on the building's exterior but was not using a personal fall arrest system on a scaffold platform with missing end rails.  The violation occurred on or about June 27, 2025.

29 CFR  1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews:  a) 543 13th Avenue, Newark, NJ  The employer did not ensure that the worker on the Alum-A-Pole pump jack scaffolding, approximately 20 feet above the ground, was protected from fall hazards. The employee was installing siding on the building from the scaffolds, where guardrails were not installed at the ends of the scaffold platform.  Violation occurred on or about June 27, 2025.

An employee was working at a height of approximately 20 feet while installing siding on the building's exterior without having the scaffold pole secured at the bottom affecting the stability of the scaffolds.  Violation occurred on or about June 27, 2025.
