29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a-  Lot 163, Kay Chiarello Way, Hamilton NJ:  Workers and the company worksite Foreman were exposed to fall hazards, in excess of 10 feet 3 inches, when accessing to and egressing from a residential structure's second floor using a portable, aluminum, extension ladder whose siderails did not extend at least three feet above the upper landing surface being accessed.  Condition observed on or about 07/22/25.

29 CFR  1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:   a-  Lot 163, Kay Chiarello Way, Hamilton NJ:  Workers and the company worksite Foreman were exposed to fall hazards, in excess of 10 feet 3 inches, when accessing to and egressing from a residential structure's second floor using a portable, aluminum, extension ladder containing damaged rungs, bent siderails, and missing one of the fly section's locking mechanisms.    Condition observed on or about 07/22/25.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a- Lot 163, Kay Chiarello Way, Hamilton NJ - Workers and the company worksite Foreman were exposed to fall hazards, in excess of 14 feet 1 inch to the ground surface, when performing framing and other related activities while working and walking at and near the unprotected, exterior facing edges of a residential structure's second floor without the use of fall protection. Condition observed on or about 07/22/25.   b- Lot 163, Kay Chiarello Way, Hamilton NJ - Workers and the company worksite Foreman were exposed to fall hazards, in excess of 10 feet 5 inches to the wooden flooring below and in excess of 13 feet 4 inches to the concrete floor below, when performing framing and other related activities while working and walking at and near the unprotected interior edges of a residential structure's second floor without the use of fall protection. Condition observed on or about 07/22/25.   c- Lot 163, Kay Chiarello Way, Hamilton NJ - Workers and the company worksite Foreman were exposed to fall hazards, in excess of 9 feet 2 inches to the wooden flooring below, when accessing an aluminum extension ladder from the top plate of an interior supporting wall   without the use of fall protection. Condition observed on or about 07/22/25.   RS Moreno Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(13)), which was contained in OSHA inspection number 1734009, citation number 1, item number 1 and was affirmed as a final order on May 20, 2024, with respect to a workplace located at 723 Balis Drive, Mullica Hill NJ.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
