29 CFR 1910.28(b)(15): Walking-working surfaces not otherwise addressed. Except as provided elsewhere in this section or by other subparts of this part, the employer did not ensure each employee on a walking working surface 4 feet (1.2 m) or more above a lower level is protected from falling by one of the systems listed in 1910.28(b)(15)(i)-(iii).   On or about July 14, 2025, at a worksite located at 6127 Lake Street, Mentor, Ohio, the employer did not ensure an employee working approximately 30 feet above the ground in a tree to remove tree branches and limbs for the removal of the tree was provided with a tree climbing fall protection system that protected the employee from falling approximately 30 feet from the tree.  The tree climbing fall protection system, consisting of a climbing line and body harness did not secure the employee while working aloft in the tree at a height of approximately 30 feet.

29 CFR 1910.30(a)(1): Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart:  On or about July 14, 2025, at a job site located at 6127 Lake Street, Mentor, Ohio, the employer did not provide fall protection training for an employee who used a tree climbing fall protection system consisting of a body harness, climbing rope, buck strap, and/or flip line, when working aloft in tree for tree trimming and tree removal operations.

29 CFR  1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident    On or about July 17, 2025, the employer failed to report a workplace fatality within the required 8 hours after learning that the employee had passed away in the hospital. The employee was initially taken to the hospital on July 14, 2025, from injuries sustained at the jobsite and later passed away on July 17, 2025.
