29 CFR 1926.1053(b)(4):Ladders shall be used only for the purpose for which they were designed. a) Jobsite located at or near 812 Graphite Drive, Phoenixville PA 19460 - On or about July 9, 2025, the employer did not ensure that the employees utilized the 6-foot Warner A-frame ladder per the manufacturer's recommendations. An employee used a Werner ladder by standing on the fourth rung while the ladder was in the closed position, leaning on a wall while preforming framing work on a new construction residential building, thereby exposing employees to fall hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Jobsite located at or near 812 Graphite Drive, Phoenixville PA 19460 - On or about July 9, 2025, the employer did not ensure employees engaged in residential construction activities 6 feet or more above lower levels were protected guardrail systems, safety net system, or personal fall arrest system. Employees were performing framing on top of the first story without the use of fall protection, thereby exposing employees to fall hazards of approximately 10 feet. MNA Construction was previously cited for a violation of this Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection number 1704257, citation number 1, item number 4 and was affirmed as a final order on April 26, 2024., with respect to a workplace located at Lot #356 N. Corner of Horsey Blvd. and Ruth Way, Chatham Bay Development
