29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about July 24, 2025, employees of Patriot Plumbing Heating and Air Conditioning were engaged in excavation activities at a jobsite located at 6616 Gray's Peak Court, Lincoln, NE 68516, and were exposed to cave-in hazards in that they were working in an unprotected trench that was in excess of 5-feet deep without any cave-in protections. This failure was most evident in the collapse of the trench in which an employee was caught within and injured.

29 CFR 1904.40(a):The employer did not provide an authorized government representative the records within the four business hours. Patriot Plumbing Heating and Air Conditioning failed to provide their OSHA 300 Logs and Form 300A for their facility located at 8333 Eiger Drive Lincoln, NE 68516 to an authorized OSHA representative within four hours of the representative making both an oral informal and a formal written request for said documents. Instances of failure to respond include but are not limited to: i. On or about July 24, 2024, when OSHA made a verbal request to the company during the opening conference and site walkaround. ii. On or about July 25, 2024, when OSHA made a written request to the company via email, quoting this requirement from the 1904.40(a). iii. On or about July 28, 2024, when OSHA made a verbal request to the company during a visit to the company headquarters while conducting interviews. ii. On or about July 28, 2024, when OSHA made a written request to the company via email, quoting this requirement from the 1904.40(a).
