OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties.  On or about July 24, 2025, and at times prior thereto, employees were exposed to the hazard of high heat from direct sun during the performance of their job duties, such as manually lifting and carrying lumber and plywood, using a hand saw to cut wood pieces, and operating a heavy-duty framing nailer, to complete new construction of two-story residential houses.  The average Wet Bulb Globe Temperature (WBGT) was 84.6 degrees Fahrenheit (F)and 88.9F respectively while the average heat index was 93.2F and 100.7F respectively. The American Conference of Government Industrial Hygienists (ACGIH) Threshold Limit Value (TLV) of 27°C/ 80.6F was exceeded indicating that the employees were exposed to excessive heat stress conditions.
