29 CFR  1926.1412(d)(1): A competent person must begin a visual inspection prior to each shift the equipment will be used, which must be completed before or during that shift. The inspection must consist of observation for apparent deficiencies. Taking apart equipment components and booming down is not required as part of this inspection unless the results of the visual inspection or trial operation indicate that further investigation necessitating taking apart equipment components or booming down is needed. Determinations made in conducting the inspection must be reassessed in light of observations made during operation. At a minimum the inspection must include (d)(1)(i) through (xiv):  (a)A-G-E Corporation at Fort Randall Dam-399 Powerhouse Road, Pickstown, SD 57367: On or about and at times prior to July 21, 2025, the employer did not ensure that a  visual inspection was conducted before or during the shift involving the Liebherr LTM 1220-5.2 Serial # 070343 mobile crane. This condition exposed employees to struck-by hazards in the event of a mechanical failure.

29 CFR  1926.1412(d)(3)(i)[A]: The monthly inspection did not have items checked and documented and the result of the inspection:   (a)A-G-E Corporation at Fort Randall Dam-399 Powerhouse Road, Pickstown, SD 57367: On or about and at times prior to July 21, 2025, the employer did not ensure monthly inspections were conducted on the Liebherr LTM 1220-5.2 Serial # 070343 mobile crane in accordance with 1926.1412 paragraph (d) prior to the shift or completed during the shift with items checked and documented to include the result of the inspection.  This condition exposed employees and subcontractor employees to struck-by hazards.

29 CFR  1926.1417(o)(1): The equipment was operated in excess of its rated capacity:  (a)A-G-E Corporation at Fort Randall Dam-399 Powerhouse Road, Pickstown, SD 57367: On or about and at times prior to July 21, 2025, the employer did not ensure that a Liebherr  LTM 1220-5.2, Serial # 070343, mobile crane was operated within the recommended specifications of the crane load chart based on the configuration of the crane. The crane attempted to lift and slew a crane dolly outside of the recommended radius of the Liebherr load chart for the configuration involving zero outriggers and no counterweights causing the crane to collapse. This condition exposed the operator to caught-in and struck-by injuries involving the loss of stability and crane collapse.
