29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a) On or about July 18, 2025, an untrained employee was allowed to operate the company's Raymond Stand-Up Counterbalanced Electric Forklift (Serial No. 425-15-44172) in the warehouse without having received formal instruction, including operator evaluation to determine the retention of the information. The untrained operator(s) and others working in the immediate area were potentially exposed to crushing and/or struck-by hazards.

1910.178(n)(8): Under all travel conditions the truck shall be operated at a speed that will permit it to be brought to a stop in a safe manner: On or about July 18, 2025, a trainee operating the company?s Raymond stand-up counterbalanced electric fork truck, serial no. 425-15-44172, operated the truck at a speed that did not permit it to be brought to a stop in a safe manner, exposing the trainee to crushing hazards. The trainee sustained an injury to his foot when he attempted to stop the truck to avoid contact with a bumper for the racking unit.
