OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed-by hazards associated with heavy equipment use: a) Worksite, trench: On or about July 28, 2025, an employee received a grade measurement for the waterline and was walking back to his truck, along a path approximately 6 inches wide, located between an active single lane roadway and a Caterpillar 321D LCR Hydraulic Crawler Excavator. The excavator operator was in the process of backing up to load sections of asphalt and concrete into a tandem dump truck when the employee was crushed beneath the right track of the excavator.
