29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section: (a) Under-construction roadway, westbound lane; On or about July 28, 2025, a Stihl brand, model TS-420, 14-inch gasoline-powered cutoff saw was used to cut down the height of a concrete manhole riser without the use of engineering control(s) to reduce dust clouds and minimize exposures to respirable crystalline silica. Specifically, an integrated water-delivery system was not used as required by Table 1, sub-paragraph (ii).
