29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: On or about July 31, 2025, at the worksite located at 8116 Wilson Ave, Kansas City, Mo 64125: Employees were exposed to caught between, struck by, and crushed by hazards while conducting scrap metal recycling activities. The employer did not ensure that powered industrial trucks not in safe operating condition were taken out of service, and/or repairs were not made by authorized personnel. Employees were operating forklifts with chunks of rubber missing from the tires. Instances include but are not limited to: Instance 1: Toyota FL 30 powered industrial truck with a tire missing chunks of rubber located in the non-ferrous building. Instance 2: Caterpillar FL 32 powered industrial truck operator with tires missing chunks of rubber located in truck/trailer/equipment maintenance shops.

29 CFR 1910.303(g)(2)(i): Except as elsewhere required or permitted by Subpart S of Part 1910, live parts of electric equipment operating at 50 volts or more were not guarded against accidental contact by use of approved cabinets or other forms of approved enclosures or by any of the means identified in paragraphs (A), (B), (C), and (D) of 29 CFR 1910.303(g)(2)(i): On or about July 31, 2025, at the worksite located at 8116 Wilson Ave, Kansas City, Mo 64125: Employees were exposed to fire and electrical shock hazards while conducting scrap metal recycling activities. The employer did not ensure that live parts of electric equipment operating at 50 volts or more were not guarded against accidental contact. Employees were working with the panel to reset lights and machinery/equipment or in direct vicinity of breaker panel with an open door/cover.

The employer did not ensure that the powered industrial trucks operated by employees in the workplace had all labels in place on the operator control levers. Instances include but are not limited to: Instance 1: Doosan powered industrial truck operator control levers in non-ferrous recovery plant. Instance 2: Toyota FL 30 powered industrial truck operator control levers in non-ferrous building. Instance 3: Caterpillar Model DP30N5 powered industrial truck operator control levers in truck/trailer/equipment maintenance shops. Instance 4: Caterpillar FL 32 powered industrial truck operator control levers in truck/trailer/equipment maintenance shops. Scrap Management Industries was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.178(a)(6), which was contained in OSHA inspection number 1827193, citation number 2, item number 1 and was affirmed as a final order on July 07, 2025 , with respect to a workplace located at 850 East 45th Street North Park City, KS.
