29 CFR 1926.200(g)(2): Traffic control signs or devices, including signs, signals, markings, barricades, and other devices, used for protection of construction workers, did not conform to Part 6 of the Manual of Uniform Traffic Control Devices ("MUTCD"), incorporated by reference in 29 CFR 1926.6: a) 1425 Route 9 Toms River, NJ: Employees were exposed to struck-by hazards. The employer failed to coordinate and provide traffic control zone from oncoming traffic while an employee was acting as a spotter for the Wirtgen Cold Milling Machine, model W 220 Fi. As a result, the employee was struck and sustained fatal injuries. Observed on or about 07/31/2025. Reference: 1926.6(n)(1) - Manual on Uniform Traffic Control Devices for Streets and Highways, 2009 Edition, December 2009 (including Revision 1 dated May 2012 and Revision 2 dated May 2012), ("MUTCD") IBR approved for ��1926.200(g) and 1926.201(a). Section 6C.10 One-Lane, Two-Way Traffic Control Standard: 01 Except as provided in Paragraph 5, when traffic in both directions must use a single lane for a limited distance, movements from each end shall be coordinated. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
