29 CFR  1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying exist:     (a) On or about July 29, 2025, at Samford University Siebert Hall, located at 800 Lakeshore Drive, Homewood, AL 35229; the employer did not ensure that adequate inspections of the job site were conducted to identify heat-related hazards and implement means to prevent heat-related illnesses.  Employees were exposed to the hazards of high heat while working outside in direct sun, during the performance of their job duties, including repair and replacing of sections of a concrete pathway for an approximately 8-hour workday.  Employees performing moderate manual labor and wearing single-layered clothing were exposed to temperatures of approximately 81-97 degrees F (27-36 degrees C) with average relative humidity levels of approximately 55%.  The calculated Wet Bulb Globe Temperatures (WBGT) between 7:53vam and 5:53 pm ranged from approximately 85 -91 degrees Fahrenheit with a Heat Index up to 107 degrees Fahrenheit.  Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:   (a) On or about July 29, 2025,at Samford University Siebert Hall, located at 800 Lakeshore Drive, Homewood, AL 35229; the employer did not provide training on information such as, but not limited to, knowledge and recognition of underlying conditions that increase the risk of heat illness, monitoring weather reports and weather advisories, onsite temperature measurements, and use of work/rest cycles based on heat conditions and category of physical work performed.  Employees were exposed to the hazards of high heat while working outside in direct sun, during the performance of their job duties, including repair and replacing of sections of a concrete pathway for an approximately 8-hour workday.  Employees performing moderate manual labor and wearing single-layered clothing were exposed to temperatures of approximately 81-97 degrees F (27-36 degrees C) with average relative humidity levels of approximately 55%.
