29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employees working from an aerial lift: a) 4888 Dune Drive, Avalon, NJ - Employees tasked with conducting painting operations from an aerial lift, approximately 20 feet above the ground, were not wearing a body belt and lanyard attached to the boom or basket, thus exposing employees to fall hazards. This condition was observed on or about July 31, 2025. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure that meets a provision described in paragraph (b) of this section. a) 4888 Dune Drive, Avalon, NJ - An employee working for the company was engaged in painting the eave of a residential home approximately 20 feet above the ground, lying on the roof with no fall protection system in place, thus exposing the employee to fall hazards. This condition was observed on or about July 31, 2025. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
