29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a) Flat Roof Smith Street Side: On or about July 31, 2026, an employee and the jobsite foreman were performing exterior painting work on a flat roof measuring approximately 55 feet by 25 feet and approximately 28 feet above grade without a fall protection system in place, exposing the workers to fall hazards.  (b) Building Entrance Flat Roof: On or about July 31, 2026, an employee was performing painting work on a flat roof up to 13ft. 6in. from grade and did not have their personal fall arrest harness and lanyard connected to anchor point, exposing the worker to a fall hazard.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.   (a) Charleston Area Alliance Jobsite: On or about July 31, 2026, the employer did not train employees or provide instruction on procedures to minimize hazards when working from heights of up to 28ft. above grade.   No abatement certification or documentation required.

29 CFR  1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift.    (a) Parking Lot Side Exterior Building Surface: On or about July 31, 2026, an employee was performing exterior painting work while working from the basket/platform of a Genie S-65 Articulating Boom Lift without the personal fall arrest harness and lanyard being attached to the provided and available anchor point, exposing the employee to a fall hazard of up to approximately 11ft. 5in. to the ground.   No abatement certification or documentation required.

(a) Charleston Area Alliance Jobsite: On or about July 31, 2026, frequent and regular inspections/audits of the worksite were not conducted to identify and correct known, open and obvious hazards, such as, employees not wearing fall protection or employees not attaching their personal fall arrest system to approved anchor points when working at heights and/or working in aerial lifts.
