29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) Flat Roof Smith Street Side: On or about July 31, 2026, an employee and the jobsite foreman were performing exterior painting work on a flat roof measuring approximately 55 feet by 25 feet and approximately 28 feet above grade without a fall protection system in place, exposing the workers to fall hazards. (b) Building Entrance Flat Roof: On or about July 31, 2026, an employee was performing painting work on a flat roof up to 13ft. 6in. from grade and did not have their personal fall arrest harness and lanyard connected to anchor point, exposing the worker to a fall hazard. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.
