29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: Location: Fabrication Shop at 202 Queen Anne Rd, Harwich, MA 02645 On or about August 22, 2025, an employee of Granite World Countertops, Inc. was exposed to an 8-hour time weighted average noise level of 88 dBA (equivalently a dose of 87.7 %) in excess of the 85 dBA action level (equivalently a dose of 50%) while polishing stone countertops. An effective hearing conservation program was not administered including monitoring, baseline & annual audiometric testing, noise training, and posting of standard 29 CFR 1910.95.

29 CFR 1910.1053(d)(1): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section: Location: Fabrication Shop at 202 Queen Anne Rd, Harwich, MA 02645 On or about July 31, 2025, employees of Granite World Countertops, Inc. were exposed to respirable crystalline silica while cutting and polishing stone countertops where the employer did not perform air monitoring to assess if each employee's exposure was above the action level.
