OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  (a)Page's Place Cafe And Grill at 700 West Kemp Avenue, Watertown, SD 57201: On or about August 1, 2025, the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause serious physical harm or death to employees from burn hazards in that that the employer did not ensure that the Avantco Oil Fryer (Model: F100, s/n: CK230364K) was secured from displacement and/or tipping over when employees performed cleaning, maintenance or cooking tasks on the equipment while the equipment was being used in an elevated, overhead, position with easily removable clamps.  This condition exposed employees to spills or splatters from hot cooking oil which could result in burns, up to and including third degree burns.  Abatement Note:  Among other methods, one feasible and acceptable abatement method to correct this hazard would be to move the Avantco Oil Fryer to a working height that prevented spills from an overhead location, as well as following manufacturer's guidelines of not moving nor transporting the fryer until oil had cooled completely.

29 CFR  1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling:  (a)Page's Place Cafe And Grill at 700 West Kemp Avenue, Watertown, SD 57201: On or about August 1, 2025, the employer did not ensure that relocatable power taps were not connected in series (daisy chained) in order to power multiple pieces of commercial cooking equipment located in the kitchen. This condition exposed employees to electrical shock and fire hazards.

29 CFR  1910.305(g)(1)(iv): Flexible cords and/or cables were used for purposes prohibited by paragraphs (A) through (F) of 29 CFR 1910.305(g)(1)(iv):  (a)Page's Place Cafe And Grill at 700 West Kemp Avenue, Watertown, SD 57201: On or about August 1, 2025, the employer did not ensure flexible cords were properly utilized in that cords were attached to building surfaces and machine surfaces via zip-ties and "U-Nails" to create a permanent wiring configurations for commercial kitchen equipment in the kitchen area.  This condition exposed employees to shock, electrocution, and fire hazards.  (b)Page's Place Cafe And Grill at 700 West Kemp Avenue, Watertown, SD 57201: On or about August 1, 2025, the employer did not ensure flexible cords were properly utilized in that cords were run through an exterior door of the building via zip-ties and "U-Nails" to create a permanent wiring configurations for external security cameras.  This condition exposed employees to shock, electrocution, and fire hazards.  (c)Page's Place Cafe And Grill at 700 West Kemp Avenue, Watertown, SD 57201: On or about August 1, 2025, the employer did not ensure flexible cords were properly utilized in that cords were run through an interior door of the building via zip-ties and "U-Nails" to create a permanent wiring configurations for commercial cooking equipment powered by RPTs.  This condition exposed employees to shock, electrocution, and fire hazards.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also included a hazardous chemicals list and methods used to inform employees of the hazards of non-routine tasks:   (a)Page's Place Cafe And Grill at 700 West Kemp Avenue, Watertown, SD 57201: On or about August 1, 2025, the employer did not develop or implement a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also included a hazardous chemicals list and methods used to inform employees of the hazards of routine and non-routine tasks for hazardous chemicals such as but not limited to degreasers and cleaning products.  This condition exposed employees to hazards associated with ingestion, inhalation or absorption of hazardous chemicals.  Abatement Note:  The written hazard communication program will also include:   (1) A list of the hazardous chemicals known to be present using an identity that is referenced on the appropriate safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and,  (2) Employee information and training to include the methods the employer will use to inform employees of the hazards of non-routine tasks.  (3) The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and safety data sheets required by this section; (4) Developed procedures for employee exposures to hazardous chemicals such as but not limited to the following chemicals: degreasers and cleaning products.
