29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck is dismounted and within 25 ft. of the truck still in his view, the load engaging means shall be fully lowered, controls neutralized, and the brakes set to prevent movement. a) On August 4, 2025 at Building #3, 205 Ann Moore St. , Dover, DE 19901 - Power Industrial Truck that was unattended when the operator dismounted. The power industrial truck had a load on it next to a scaffold exposing 4 employees to a fall hazard.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. a) On August 4, 2025 at Building #3, 205 Ann Moore St. , Dover, DE 19901 - Foreman and employees were exposed to fall by not placing a ladder at the scaffold to permit access to the working platform.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) On August 4, 2025 at Building #3, 205 Ann Moore St. , Dover, DE 19901 - CSHO observed three employees working on a scaffold without fall protection. The employees were exposed to fall hazards at an elevation of 15 feet while placing concrete and decorative stone on the building facia.
