29 CFR  1910.135(a)(1):The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:  On or about August 1, 2025, at the jobsite located at  the North Intersection of R Road and 360 Ave in the Southwest/4 sec 29-13-21 W in Hays, KS, employees engaged in oil and gas equipment maintenance and servicing were exposed to struck-by hazards. Employees were working under an A-frame derrick of a winch truck that was utilized to lift a wrist pin of a pumping unit.  The A-frame  poles fell and struck the employees that were not utilizing hard hats.

29 CFR  1910.181(j)(2)(ii):The employer did not ensure that a safety latch type hook was used whenever possible.  On or about August 1, 2025, at the jobsite located at  the North Intersection of R Road and 360 Ave in the Southwest/4 sec 29-13-21 W in Hays, KS, employees engaged in oil and gas equipment maintenance and servicing were exposed to struck-by hazards. Employees were working under an A-frame derrick of a winch truck that was utilized to lift a wrist pin of a pumping unit.  The Crosby Lebus 1-2-5-8 hook did not have a latch and came off  the anchor point, causing the poles to fall and struck the employees.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   At the main office area, employees engaged in oil and gas equipment maintenance and servicing activities were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the job site. Employees utilize chemicals such as but not limited to:gasoline, brake cleaner and crude oil as part as their tasks. The chemical hazards associated with these chemicals include ; skin and eye damage/irritation, may cause an allergic skin reaction, drowsiness and/or dizziness, respiratory tract irritation, may cause cancer and may be fatal if swallowed and flammability.

The chemical hazards associated with these chemicals include ; skin and eye damage/irritation, may cause an allergic skin reaction, drowsiness and/or dizziness, respiratory tract irritation, may cause cancer and may be fatal if swallowed and flammability.

29 CFR  1910.132(d)(2):The employer did not verify, through a written certification, the identity of the workplace evaluated, the person certifying that the evaluation had been performed, and the date the hazard assessment was done:  On or about August 1, 2025, at the jobsite located at  the North Intersection of R Road and 360 Ave in the Southwest/4 sec 29-13-21 W in Hays, KS, employees engaged in oil and gas equipment maintenance and servicing were exposed to struck-by hazards. The employer did not have a hazard assessment certification indicating the hazards present at the jobsite and the proper measures and PPE to help protect employees. Three employees were struck by-a from from the A-frame derrick. Employees were not utilizing a hard hat.
