29 CFR  1910.28(b)(7): The employer did not ensure that each employee on a walking-working surface near an opening, including one with a chute attached, where the inside bottom edge of the opening is less than 39 inches (99 cm) above that walking-working surface and the outside bottom edge of the opening is 4 feet (1.2 m) or more above a lower level is protected from falling by the use of one of the systems listed in 29 CFR 1910.28(b)(7)(i)-(iv).  On or about July 30, 2025, an employee of E&H Hardware Group, LLC utilized the door key to open the hoist way door of the Otis Elevator (ID #5785) and accessed the elevator hoist way. The elevator car was not located where the hoist way door was opened, creating an unguarded wall opening. The employee fell approximately 22 feet through the wall opening resulting in injuries requiring hospitalization.

29 CFR  1910.145(f)(5): Danger tags were not used where an immediate hazard presented a threat of death or serious injury to employees.  On or about July 30, 2025, an employee of E&H Hardware Group, LLC utilized the elevator hoist way door key to open the (first floor) hoist way door of the Otis Elevator (ID #5785) and accessed the elevator hoist way. The elevator car was not located where the hoist way door was opened creating an unguarded wall opening. The employer did not utilize a danger tag or signage to notify employees of an immediate fall hazard.  An employee fell approximately 22 feet through the unguarded wall opening resulting in serious injuries.
