29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system. On or about August 4, 2025, and at times prior; at 1020 Emerald Creek Drive, Valrico, Florida, employees were exposed to a 10-to-15-foot fall hazard while involved in roof activities such as installing tarp on a 5 in 12 pitched (vertical to horizontal) roof, in that, fall protection was not used.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a. On or about August 4, 2025 at 1020 Emerald Creek Drive, Valrico, Florida, employees engaged in roof activities such as installing tarp, on a 5:12 pitched roof were exposed to a fall hazard of approximately 10 to 15 feet. The employer failed to provide training to employees on how to recognize and minimize fall hazards.
