29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment:   a) At the site located at Poigai Subdivision on Bright Road in Bentonville, AR; on July 21, 2025, the employer did not ensure that adequate inspections of the job site to identify heat related hazards and implement means to prevent heat-related illnesses. Employees were exposed to the hazard of high heat from the sun during the performance of their job duties. The calculated Wet Bulb Globe Temperature (WBGT) ranged from 27?- 32? (81? to 90?) and a calculated heat index of 81? to 102? while working outdoors for approximately 8 hours conducting light to moderate duties changing between operating excavator and front-end loader and wearing short sleeve shirts and short pants. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.  b) At the site located at Poigai Subdivision on Bright Road in Bentonville, AR; on July 22, 2025, the employer did not ensure that adequate inspections of the job site to identify heat related hazards and implement means to prevent heat-related illnesses. 29 CFR  1926.50(c): In the absence of an infirmary, clinic, hospital, or physician, that is reasonably accessible in terms of time and distance to the worksite, which is available for the treatment of injured employees, a person who has a valid certificate in first-aid training from the U.S. Bureau of Mines, the American Red Cross, or equivalent training that can be verified by documentary evidence, was not available at the worksite to render first aid:  a) On or about July 22, 2025, at Poigai Subdivision on Bright Road in Bentonville, AR; the employer did not ensure prompt first aid treatment for injured employee by not making available a first aid trained provider during a medical emergency such as a heat-related illness.
