29 CFR 1910.269(p)(1)(i):The employer did not ensure that critical safety components of mechanical elevating and rotating equipment received a thorough visual inspection before use on each shift. On or about July 21, 2025, Southwest Tree LLC, did not ensure that critical safety components of the Jarraff All-Terrain Tree Trimmer were inspected prior to use at a worksite located at Highway YY in Cook Station, Missouri. An employee was critically injured when a hydraulic line on the mechanical equipment failed.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. On or about July 21, 2025, Southwest Tree, LLC, failed to report an in-patient hospitalization within 24 hours. An employee was operating a Jarraff All-Terrain Tree Trimmer when a malfunction occurred injuring the employee. The employee was hospitalized the same day. The employer reported the in-patient hospitalization two weeks after the incident, on August 4, 2025.
