29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  On or about August 7, 2025, at a worksite located at 1600 East North Avenue, Appleton, Wisconsin, the employer had not initiated and maintained accident prevention programs for employees performing installation of sheathing who were exposed to hazards such as, but not limited to, falls from elevated surfaces and scaffolds.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  On or about August 7, 2025, at a worksite located at 1600 East North Avenue, Appleton, Wisconsin, employees were exposed to fall hazards of 14.9 feet while egressing the roof using a JLG scissor lift (Model No.: SCR242037B, Serial No.: 05013925).  The scissor lift railing was missing a top rail and midrail at the entry point of the lift.

29 CFR  1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems: Note:  If the employer could demonstrate that it was infeasible or created a greater hazard to use these systems, a fall protection plan meeting the requirements of paragraph (k) of 1926.502 should have been developed and implemented.  On or about August 7, 2025, at a worksite located at 1600 East North Avenue, Appleton, Wisconsin, employees were exposed to fall hazards of 14.9 feet and 21 feet while installing sheathing on a low slope roof without the use of conventional fall protection.

29 CFR 1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  On or about August 7, 2025, at a worksite located at 1600 East North Avenue, Appleton, Wisconsin, the employer did not certify that employees exposed to fall hazards of 14.9 feet and 21 feet while installing sheathing had received training in the recognition of fall hazards and methods to mitigate those hazards prior to exposure.
