29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average (TWA) sound level of 85 decibels measured on the A scale (dBA), or equivalently a dose of fifty percent: (a) On or about August 8, 2025, and at times prior, employees were exposed to noise exceeding a TWA of 88 dBA, a 76% dose during normal operations. The employer did not administer an effective hearing conservation program in that: (1) The employer did not develop and implement a monitoring program for employee noise exposure. (2) The employer did not provide an audiometric testing program for employees. (3) The employer did not provide a selection of hearing protectors for employees to choose from.
