29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment: (a)Warehouse, 355 Davidsons Mill Road Jamesburg, NJ 08837 On or about August 6, 2025, the employer did not assess the workplace to determine whether hazards were present that would necessitate personal protective equipment (PPE), such as rubber boots. Employees who clean chemical spills, including HLC-3000, Liquid Heavy Duty Alkaline Cleaner, wear safety shoes; however, the safety data sheet for HLC-3000, Liquid Heavy Duty Alkaline Cleaner indicates the use of rubber boots to prevent skin contact.

29 CFR 1910.176(b): The employer did not ensure that bags, containers, bundles, etc., stored in tiers shall be stacked, blocked, interlocked and limited in height so that they are stable and secure against sliding or collapse. a) Warehouse, 355 Davidsons Mill Road Jamesburg, NJ 08837 On or about August 6, 2025, an employee was removing a pallet from the racks when the forklift struck a pallet, causing a Bunzel case containing a box of HLC-3000, Liquid Heavy Duty Alkaline Cleaner, to fall and spill onto the ground. The Bunzel cases on the pallets were not stable or secured to prevent sliding or collapse.

29 CFR 1910.1200(b)(4)(iii): In work operations where employees only handle chemicals in sealed containers which are not opened under normal conditions of use, the employer did not ensure that employees were provided with information and training in accordance with 29 CFR 1910.1200(h) to the extent necessary to protect them in the event of a spill or leak of a hazardous chemical for a sealed container: (a) Warehouse, 355 Davidsons Mill Road Jamesburg, NJ 08837 On or about August 6, 2025, an employee was removing a pallet from the racks when the forklift struck a pallet, causing a case from Bunzel containing a box of HLC-3000, Liquid Heavy Duty Alkaline Cleaner, to fall and spill onto the ground. The employee then picked up the box of HLC-3000, Liquid Heavy Duty Alkaline Cleaner, causing the chemical to spill on their left foot. The employee had not been properly trained in the necessary work practices to protect themselves in the event of a chemical spill.
