29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 21104 Astoria Lane, Lot 34 Parkview, Silverhill, Alabama:  On August 18, 2025; the employer allowed his employees to perform framing activities without using fall protection exposing his employees to a fall hazard of 9 feet 9 inches to the ground below.  The Oscar Antonio Bardales dba Oscar Antonio Bardales was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(B)(13), which was contained in OSHA inspection number 1585731, citation number 1, item number 1 group B and was affirmed as a final order on May 26, 2022, with respect to a workplace located at 10848 Native Dancer Way, Lot 529Jubilee Farms, Daphne, Alabama and in inspection number 1803256, citation number 2, item number 1  and was affirmed as a final order on April 1, 2025, with respect to a workplace located at 10993 Secretariat Boulevard, Lot 388Jubilee Farms, Daphne, Alabama.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)  At 21104 Astoria Lane, Lot 34 Parkview, Silverhill, Alabama:  On August 13, 2025; the employer allowed his employees to perform framing activities without first ensuring his employees were trained on the hazards associated with falls to include but not limited to setting up and inspecting fall protection exposing his employees to a fall hazard of 9 feet 9 inches to the ground below.  The Oscar Antonio Bardales dba Oscar Antonio Bardales was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(A)(1), which was contained in OSHA inspection number 1585731, citation number 1, item number 1 group A and was affirmed as a final order on May 26, 2022, with respect to a workplace located at 10848 Native Dancer Way, Lot 529Jubilee Farms, Daphne, Alabama and in inspection number 1803256, citation number 2, item number 2  and was affirmed as a final order on April 1, 2025, with respect to a workplace located at 10993 Secretariat Boulevard, Lot 388Jubilee Farms, Daphne, Alabama.
