29 CFR 1926.451(c)(2)(i):Footings shall be level, sound, rigid, and capable of supporting the loaded scaffold without settling or displacement. a.) On or about August 4th, 2025, at the Gateway Project in Cincinnati, the employer failed to ensure that the south-side scaffold was supported by level, sound, and rigid footings. The employer removed the scaffold's footings and instead secured the upper frames to the building's interior wall and door frames using ropes and ratchet straps. As a result, employees installing brick on the residential structure were exposed to a struck-by and tipping hazard from potential scaffold displacement

29 CFR 1926.454(b): The employer shall have each employee who is involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question. The training shall include the following topics, as applicable: (b)(2) The correct procedures for erecting, disassembling, moving, operating, repairing, inspecting, and maintaining the type of scaffolding in question. a.) On or about August 4th, 2025, at the Gateway Project in Cincinnati, the employer failed to ensure that employees erecting and modifying the south-side scaffold were trained by a competent person in the proper procedures. This resulted in a scaffold being erected by tying the top-tier frames to the building's interior door frames with ropes and ratchet straps and raising the scaffold without footings, while concrete finishers worked beneath the floating side. As a result, employees were exposed to a struck-by hazard from potential scaffold collapse.
