29 CFR  1926.20(b)(2): The employer did not initiate and maintain an accident prevention safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person.  On or about August 12, 2025, and times prior thereto, at the N. Bryant worksite, frequent and regular inspections of the worksite and the equipment being used by employees to perform masonry work activities at the worksite were not initiated by a competent person.

29 CFR  1926.451(c)(2)(v): The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied.   On or about August 12, 2025, and times prior thereto, in the northwest corner of the bay, an employee was working from a personnel platform (PP) that was not secured to the forks of a powered industrial truck (PIT).

Note:  If such modifications or changes were made, the capacity, operation, and maintenance instruction plates, tags, or decals should have been changed accordingly.  On or about August 12, 2025, and times prior thereto, in the northwest corner of the bay, an employee was working from a personnel platform (PP) that was not centered while elevated on the forks of a powered industrial truck (PIT), and the forks carriage was not securely seated and attached to the boom of the PIT.

29 CFR  1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.  On or about August 12, 2025, and times prior thereto, in the northwest corner of the bay, employees were performing masonry work activities from a personnel platform (load) that was not stable on the powered industrial truck (PIT), was not adequately secured to the PIT, was not loaded within load capacity or safety factors, and lacked safe loading instructions for the attachment.
